Terms & Conditions

These Terms & Conditions apply to driving lessons, driving assessments, test day services and related services provided by Let’s Go Drive Sydney.

By making a booking, you agree to these Terms & Conditions.

Where a booking is made for a person under 18, the parent or guardian making or authorising the booking agrees to these Terms & Conditions on their behalf to the extent permitted by law.

Our Commitment to You

At Let’s Go Drive Sydney, we are committed to providing professional, individualised driver training in a safe, supportive and respectful learning environment.

You can expect:

  • professional instruction tailored to your experience, ability and goals
  • clear and constructive feedback
  • training focused on safe, low risk driving skills as well as preparation for the NSW driving test where appropriate
  • a clean, well maintained and appropriately equipped training vehicle when using the Let’s Go Drive Sydney vehicle
  • punctual and reliable service
  • respectful and professional communication
  • reasonable notice if circumstances require a booking to be changed
  • your personal information to be handled appropriately and in accordance with our Privacy Policy.

Our aim is not simply to help you pass a driving test. It is to help you develop the skills, judgement and confidence needed to become a safer and more capable driver.

1. Bookings

All bookings are subject to availability and are not confirmed until accepted by Let’s Go Drive Sydney.

Customers are responsible for providing accurate contact details, pickup information and booking details.

Where the person receiving the lesson or assessment is under 18, a parent or guardian may make and manage bookings on their behalf.

Bookings may be confirmed and communicated by email, SMS or other electronic communication.

Booking reminders may also be provided as a courtesy. Customers remain responsible for keeping track of their confirmed bookings and advising us if their contact information changes.

2. Payment

Payment is required by the scheduled commencement time of the lesson, assessment or other service unless another arrangement has been agreed.

Prices are those advised at the time of booking and may vary according to the service, duration, location or other booking requirements.

Let’s Go Drive Sydney may change its prices from time to time.

A price change will not affect a service that has already been booked and paid for unless otherwise agreed.

3. Cancellations and Rescheduling

We understand that plans sometimes change.

If you need to cancel or reschedule a booking, please provide at least 24 hours notice.

Where less than 24 hours notice is provided, the full booking fee may be charged because the reserved appointment may not reasonably be able to be offered to another customer.

Cancellation fees will be applied reasonably having regard to the circumstances and any rights available under the Australian Consumer Law.

If Let’s Go Drive Sydney needs to cancel or reschedule a booking, we will provide as much notice as reasonably possible and arrange another suitable time.

Any amount already paid for a service that we cancel will be transferred to the replacement booking or refunded if a suitable replacement cannot be arranged.

4. Lesson Time and Professional Instruction

The booked lesson time forms part of the professional instruction provided by Let’s Go Drive Sydney.

Depending on the learner and purpose of the lesson, instructional time may include:

  • a pre drive discussion
  • explanation or demonstration of driving techniques
  • practical driving
  • manoeuvre practice
  • hazard perception and low risk driving instruction
  • driving test preparation
  • feedback and discussion at the conclusion of the lesson.

Not all instructional time will necessarily involve the vehicle being driven.

Briefing, explanation, demonstration and feedback are important parts of professional driver training and may form part of the booked lesson time.

5. Late Arrival

Please be ready at the agreed pickup location at the scheduled starting time.

If you are late, the lesson may still finish at the originally scheduled finishing time so that subsequent customers are not disadvantaged.

If the instructor is running late, reasonable efforts will be made to provide the full booked lesson time or otherwise make up the lost time.

6. Licence Requirements

You must hold a current and valid driver licence or learner licence appropriate for the vehicle and type of driving being undertaken.

You must comply with all conditions applying to your licence.

You must tell the instructor before driving if your licence has been suspended, cancelled, expired or otherwise affected in a way that may prevent you from legally driving.

You may be asked to produce your licence before driving.

7. Fitness and Safety to Drive

You must be fit and legally permitted to drive at the time of your lesson or assessment.

A lesson or assessment may be stopped, postponed or refused where the instructor reasonably considers that continuing would create an unacceptable safety risk.

This may include circumstances involving:

  • alcohol or drugs
  • extreme fatigue
  • unsafe behaviour
  • inappropriate footwear
  • a condition or circumstance that makes driving unsafe or unlawful.

Safety of the customer, instructor, passengers and other road users takes priority over completing a lesson or assessment.

8. Professional Standards and Insurance

Let’s Go Drive Sydney provides professional driving instruction using an appropriately licensed driving instructor and maintains appropriate business and vehicle insurance.

The Let’s Go Drive Sydney training vehicle is covered by comprehensive motor vehicle insurance.

Let’s Go Drive Sydney also maintains public liability insurance and professional indemnity insurance in connection with the services provided.

All insurance cover is subject to the terms, conditions, limits and exclusions of the relevant insurance policies.

The training vehicle is maintained to an appropriate standard for professional driving instruction and is equipped with instructor controls appropriate to the vehicle and service being provided.

9. Instructor Intervention

Driving instruction takes place in real world road and traffic conditions.

The instructor may give verbal directions or take reasonable action when necessary for safety.

This may include:

  • using instructor controls
  • assisting with steering
  • directing the customer to slow down or stop
  • terminating a driving activity where continuing would be unsafe.

The instructor may end a lesson where a customer repeatedly refuses to follow reasonable safety directions or behaves in a way that creates an unacceptable risk.

10. Using Your Own Vehicle

Lessons or assessments may, by prior agreement, be conducted in a customer's vehicle.

The customer is responsible for ensuring that the vehicle is:

  • currently registered
  • roadworthy
  • appropriately insured
  • legally permitted to be driven
  • suitable for the intended lesson or assessment.

The instructor may inspect the vehicle before commencing and may refuse to conduct or continue a lesson or assessment in a vehicle that is reasonably considered unsafe or unsuitable.

11. Traffic Offences

Customers are responsible for complying with all applicable road rules and licence conditions while driving.

The instructor will provide instruction, supervision and reasonable intervention where necessary but cannot guarantee that a customer will not commit a traffic offence.

Where a fine, penalty or infringement is legally attributable to the customer as the driver, responsibility for that fine, penalty or infringement rests with the customer.

If an infringement notice is initially issued to Let’s Go Drive Sydney or the registered operator of the vehicle, the customer's details may be provided to the relevant authority where permitted or required by law.

12. Learner Logbook Hours

Where applicable, structured driving lessons may qualify for bonus learner logbook hours in accordance with current Transport for NSW requirements.

Eligibility for bonus hours is determined by the applicable Transport for NSW rules.

Customers remain responsible for ensuring that their learner logbook and driving experience requirements are complete and accurate.

13. Driving Tests and Test Day Bookings

Let’s Go Drive Sydney can provide driving test preparation and, where agreed, a vehicle and instructor for a practical driving test.

Test Day Service

A test day booking reserves the instructor, vehicle and allocated time specifically for the customer.

Depending on the service booked, this may include:

  • pickup
  • a pre test warm up
  • travel to the testing centre
  • use of the vehicle during the driving test
  • return travel where included in the booking.

Because a larger period of instructor and vehicle time is reserved for a test day booking, different cancellation conditions may apply from those applying to an ordinary driving lesson.

Cancelling or Changing a Test Day Booking

Customers should provide at least 24 hours notice if they need to cancel or change a test day booking.

Where less than 24 hours notice is provided, the full test day booking fee may be charged because the instructor, vehicle and allocated time have been specifically reserved and may not reasonably be able to be rebooked.

If the customer wishes to change their Transport for NSW driving test appointment, they should confirm that Let’s Go Drive Sydney is available for the proposed new date and time before changing the test.

Changing a Transport for NSW test appointment does not automatically transfer or reschedule the customer's booking with Let’s Go Drive Sydney.

Any cancellation fee will be applied reasonably having regard to the circumstances and does not affect rights or remedies available under the Australian Consumer Law.

Transport for NSW Delays or Cancellations

Driving tests are administered by Transport for NSW and are outside the control of Let’s Go Drive Sydney.

Let’s Go Drive Sydney is not responsible for a test being delayed, cancelled, relocated or otherwise changed by Transport for NSW.

If this occurs, any charge relating to instructor time, vehicle use or time already spent attending the test will be dealt with reasonably according to the circumstances.

Customer Eligibility

The customer is responsible for ensuring that they are eligible to sit the test and have satisfied all applicable Transport for NSW requirements.

This includes having the correct licence, identification, logbook requirements and any other required documentation or approvals.

If a test cannot proceed because the customer:

  • is not eligible
  • does not attend
  • arrives too late
  • does not have the required documentation
  • has not satisfied Transport for NSW requirements

the test day booking may still be charged in full.

Vehicle Availability

Where the Let’s Go Drive Sydney vehicle has been booked for the test, reasonable steps will be taken to ensure that it is available, registered, roadworthy and suitable for the test.

If the vehicle unexpectedly becomes unavailable and Let’s Go Drive Sydney cannot provide the booked service, reasonable efforts will be made to provide an alternative arrangement.

If the booked service cannot be provided, any amount paid for the service that was not provided will be refunded or credited subject to the customer's rights under the Australian Consumer Law.

Test Outcomes

Booking lessons, receiving a recommendation to attempt the test or using the Let’s Go Drive Sydney vehicle does not guarantee that a customer will pass.

The driving test is conducted and assessed independently by Transport for NSW.

The decision to pass or fail a customer is made by the authorised testing officer and is outside the control of Let’s Go Drive Sydney.

14. Older Driver Assessments

Older Driver Assessments are conducted professionally, independently and in accordance with applicable NSW requirements and the conditions applying to the assessor's accreditation.

An assessment booking does not guarantee a successful assessment outcome.

The assessor must make an independent assessment of the driver's performance.

An assessment result cannot be altered because of personal circumstances, previous driving history or the preferences of the driver, family members or another person.

Where Transport for NSW, a medical practitioner or another authorised body imposes particular requirements, those requirements take precedence.

15. Lesson and Assessment Outcomes

Every driver develops at a different rate.

Let’s Go Drive Sydney does not guarantee that a particular number of lessons will result in a customer:

  • being ready to drive independently
  • being ready to attempt a driving test
  • passing a driving test
  • achieving a particular assessment outcome.

Recommendations about further training, driving development or readiness for a driving test represent the instructor's professional assessment at that time.

16. Weather and Unexpected Events

A lesson, assessment or test day service may occasionally need to be changed, shortened or cancelled where circumstances make it unsafe or impractical to continue.

This may include severe weather, road closures, emergencies, vehicle problems or other circumstances outside the reasonable control of Let’s Go Drive Sydney.

Where this occurs, the affected booking will be dealt with reasonably having regard to the circumstances and any applicable consumer rights.

17. Professional and Respectful Conduct

Customers can expect to be treated professionally and respectfully.

Customers are also expected to treat the instructor and other people involved in the service respectfully.

Threatening, abusive, discriminatory, dangerous or seriously inappropriate behaviour will not be accepted.

Let’s Go Drive Sydney may end or refuse a service where continuing would be unsafe or unreasonable.

18. Personal Property

Customers are responsible for personal belongings brought into a vehicle.

Please check that you have all belongings with you at the conclusion of your lesson, assessment or test day service.

19. Privacy

Personal information provided in connection with bookings and services is handled in accordance with the Let’s Go Drive Sydney Privacy Policy and applicable privacy requirements.

20. Australian Consumer Law

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

Services supplied by Let’s Go Drive Sydney come with consumer guarantees under Australian Consumer Law including applicable guarantees that services will be provided with due care and skill and be reasonably fit for their intended purpose.

Where a customer is entitled to a remedy under Australian Consumer Law, these Terms & Conditions do not limit that entitlement.

21. Changes to These Terms

These Terms & Conditions may be updated from time to time to reflect changes to our services, business practices or legal requirements.

The Terms & Conditions applying to a booking will generally be those in effect when the booking is made except where a change is required by law.
